A suit which was filed by Edward Freels, Sr. of Anderson County, Tn againist Jarrett Willingham, Beverly Freels Administratiors and Catherine Freels, Administratior of the estate of Edward Freels, junior, is found in the old circuit court files of Daviess County, Kentucky which are located in the courthouse in Owensborough. These files contain more than twenty recordings relating to the case and the depositions contain the most valuable information, so far located, to establish the identities and relationship of the Freels in Kentucky to the Freels in Tennessee.

The suit was filed June 14, 1820 by Edward Freels, Sr. in brief, states that his son Edward Jr. had loaned to him a sum of money $150.00 and he had given to Edward Jr. as mortgage for the loan of a certain young negro girl named Betsy. Following the death of Edward Jr. in 1818, Edward Sr. tendered the $150.00 to the administrators of his son's estate however they refused to return the negro girl Betsy, saying that she had been purchased by Edward Jr. from his father.

Various documents reveals that about the year 1809 in Anderson County, Tn. Edward Freels, Sr. needed to stay the sheriff's execution on two negro girls and not having the fund, he borrowed from his son, Edward Jr., the sum of $150.00.

It seems that Edward jr. later moved to White County, Tn. where his brother, Thomas Freels also lived. About the year 1813 Edward Jr. contemplated to moved to Kentucky and returned to Anderson County to settle his affairs and vist his father. Apparently his father was unable to repay Edward Jr., his loan at this time, and offered to his son a young negro girl as mortgage. Edward Sr., discussed with Nancy and Nancy stated that she would keep Sophy but allowed Betsy to go with Edward Jr. Betsy was judged a young negro girl and probably about the age of ten or twelve, she went off sitting behind Edward Jr. on his horse.

After a while Edward Jr. returned to White County, he asked his brother, Thomas then going to Anderson County, to inquire of their father if he would give a bill of sale for the negro girl, Betsy and allow Edward Jr. to send additional payment. He reported that his father declined this offer and refused to issue a bill of sale.

A few weeks after this Edward Jr. moved to Daviess County, Kentucky. Edward's wife as Catherine Willingham, the daughter of Jarrett Willingham, who lived in Henderson County, Kentucky. In December of 1818 it is learned that Edward Jr. estate is being settled in Daviess County. he died intestate and he probably died in September of that year.

Edward Sr. apparently learning of his son's death, requested that his son Thomas, act as his agent and in December 1818 Thomas offered Jarrett Willingha, the administrator $150.00 for the loan and requested the return of the negro girl, Betsy. Jarrett Willingham refused the money and Thomas then returned the $150.00 to his father, Edward Sr.

The case continued in court for two years. There is no date of the final decree but the last deposition was in March of 1822. During this time the son, Anderson becomes agent for his father Edward Sr. In several instances the name of Thomas is crossed out and Anderson is written instead.

The court rules that the administrators are to accept the $150.00 and release the negro girl Besty to (Thomas) Anderson Freels.

The deposition of particular interest is the one request by Thomas Friedls on February 21, 1821 to have the evidence of Isaac Freilds who lives out the state of Kentucky.

Isaac Freels in White County, Tennessee at the courthouse in Sparts, gives his deposition on the 5th of March 1821 and declares that his age is about 46 years old, Edward Freels, Jr. called his brother, he indicates he last talked with him about six years ago. His statements support those of his father, Edward Sr. Isaac signs with his mark, which is an O. This is rather unusual mark and might possible be interpreted to signify O'Freels on Jun 14, 1820 Daviess County, Kentucky.
